Utah's surrogacy statute was passed in 2008, but it included discriminatory language. In 2015, the statute became inclusive of same-sex couples, after the U.S. Supreme Court's history ruling in Obergerfell v. Hodges. In 2019, the Utah Supreme Court held that “same-sex couples must be afforded all of the benefits the State has linked to marriage and freely grants to opposite sex-couples"—including the surrogacy law. In 2020, the surrogacy statute was amended (HB 234) to remove discriminatory language and comply with the affirmative ruling of the Utah Supreme Court.
